# Terms of Service

These Terms of Service ("Terms") are entered into between you and **High-End Hawaii LLC**, a Hawaii limited liability company doing business as "High-End Hawaii." By accessing our website at highendhawaii.com or using our services, you agree to be bound by these Terms.

## Acceptance of Terms

By booking a tour, submitting a contact form, or otherwise using our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

## Booking & Payment

A deposit may be required at the time of booking. Full payment is due prior to the tour date. We accept major credit cards and other payment methods as specified during the booking process. All prices are quoted in US Dollars (USD).

## SMS/Text Messaging Terms

By providing your phone number and opting in via our contact form, you consent to receive text messages from High-End Hawaii LLC regarding your tour inquiry, booking confirmations, reminders, and related communications.

-   **Message Frequency:** Message frequency varies based on your interactions and bookings.
-   **Opt-Out:** You may opt out at any time by replying **STOP** to any message. Upon opting out, you will receive one final confirmation message and no further messages will be sent.
-   **Help:** Reply **HELP** for assistance or contact us at reservations@highendhawaii.com or +1 (808) 204-4745.
-   **Carrier Charges:** Message and data rates may apply. High-End Hawaii LLC is not responsible for charges from your wireless carrier.
-   **Supported Carriers:** Compatible with major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others.
-   **No Purchase Required:** Consent to receive text messages is not a condition of purchasing any goods or services.
-   **Age Requirement:** You must be 18 years of age or older to use this SMS service.

## Tour Modifications

We reserve the right to modify tour itineraries due to weather conditions, road closures, or other circumstances beyond our control. We will make every effort to provide alternative experiences of equal value.

## Liability

While we take every precaution to ensure your safety, participation in tours involves inherent risks. By booking, you acknowledge these risks and release High-End Hawaii LLC from liability for any injuries or damages that may occur during the tour experience.

## Intellectual Property

All content on this website, including text, images, logos, and design, is the property of High-End Hawaii LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

## Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to conflict of law principles.
